Description/Overview:
This course will provide a brief refresh on the basics of insolvency procedures in the Cayman Islands whilst also exploring some of the more advanced and complicated aspects of a liquidation process and the challenges faced working in an offshore jurisdiction.

Presenters:
Jason Robinson, Director, Teneo – Jason has over 14 years of experience assisting clients in the financial services sector, having worked in Canada and the Cayman Islands. While in the Cayman Islands, he has played a central role in various cross-border restructuring and insolvency matters, involving Cayman domiciled entities with assets and/or recovery actions in a variety of jurisdictions. Jason has been appointed as a provisional and official liquidator by the Grand Court of the Cayman Islands, controller by the Cayman Islands Monetary Authority, and acted as a foreign representative as part of Chapter 15 recognition proceedings in the United States Bankruptcy Court. Jason has also acted as voluntary liquidator to several entities in the Cayman Islands. Jason is a Chartered Professional Accountant of Canada, qualified insolvency practitioner in the Cayman Islands, and a Fellow of INSOL International.
Cally Daly, Manager, Teneo – Cally has over 10 years of experience assisting clients in a variety of sectors including, financial services, operating companies, hospitality, and the public sector, during her time in South Africa, the United Kingdom and in the Cayman Islands. While in the Cayman Islands, she has gained significant experience working on voluntary, provisional and official liquidations as well as controllerships and is highly skilled at managing stakeholder interests throughout these processes. Cally’s most recent experience includes complex cross border insolvencies including financial investigations, asset recovery and litigation both in the Cayman Islands and abroad.

Learning Objectives:
To provide an understanding of the basic principles and processes of liquidations in the Cayman Islands and an overview of some of the more advanced scenarios arising in insolvency proceedings. The course will provide an awareness of common challenges faced by liquidators and key strategies for success. Topics to be discussed include:

·       Summary of liquidation processes and objectives of the same;
·       Importance of and the challenges in relation to obtaining books and records;
·       Cross border insolvency and recognition of Cayman Islands proceedings;
·       Role of a Liquidation Committee;
·       Creditor claims and distribution considerations;
·       Investigations;
·       Litigation - challenges, pitfalls, reasons to pursue;
·       Funding in insolvent or cash stripped estates; and
·       Restructuring Officers - relevant features of the new regime.
