Description/Overview:

This course will provide a brief refresh on the basics of insolvency procedures in the Cayman Islands whilst also exploring some of the more advanced and complicated aspects of a liquidation process and the challenges faced working in an offshore jurisdiction.

Presenters:

Jason Robinson, Director, KPMG – has more than 13 years of experience with KPMG, working across audit, tax, and advisory. Jason has played a central role in several Cayman Islands’ restructuring matters, including voluntary liquidations and court appointments. His experience has involved numerous cross-border engagements of Cayman domiciled companies with subsidiaries and/or recovery actions in a variety of jurisdictions. Jason is a Chartered Professional Accountant of Canada, Affiliate Member of the Insolvency Practitioners Association of the United Kingdom and a Fellow, INSOL International.

Cally Daly, Manager, KPMG – has worked in restructuring since 2018 in both the Cayman Islands and the United Kingdom. Cally has experience with voluntary, provisional, and official liquidations and controllerships in the Cayman Islands, and a number of large CVAs and pre-pack liquidations in the United Kingdom. These engagements have included complex financial investigations, asset recovery through litigation both in the Cayman Islands and abroad, cross border recognition and the sale of business interests across investment funds, insurance companies and operating entities.

Learning Objectives:

To provide an understanding of the basic principles and processes of liquidations in the Cayman Islands and an overview of some of the more advanced scenarios arising in insolvency proceedings. The course will provide an awareness of common challenges faced by liquidators and key strategies for success. Topics to be discussed include:


·       Summary of liquidation processes and objectives of the same;

·       Importance of and the challenges in relation to obtaining books and records;

·       Cross border insolvency and recognition of Cayman Islands proceedings;

·       Role of a Liquidation Committee;

·       Creditor claims and distribution considerations;

·       Investigations;

·       Litigation - challenges, pitfalls, reasons to pursue; and

·       Funding in insolvent or cash stripped estates.
